Terms of Service

These terms are an agreement between you and Twingdle ("Twingdle", "we", "us") for the use of the Twingdle mobile app and website (the "Service"). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.

1. Accounts and eligibility

• You must be at least 18 years old, or the age of majority where you live, to create an account. The Service is for adults to make stories for children; children may enjoy the stories but may not hold an account.
• You are responsible for keeping your password secure and for everything done under your account.
• One person, one account. Please give us accurate information and keep it up to date.
• You can delete your account at any time from the Delete your account page.

2. Credits and purchases

• Credits are the unit used to pay for generating scenes, pictures, narration, characters and covers. The number of credits each action costs is shown in the app before you confirm.
• New accounts receive a one-time welcome grant of credits. We may change the size of this grant for new accounts at any time.
• Credit packs are one-time purchases. Purchased credits do not expire while your account exists.
• All purchases are made through Apple's App Store or Google Play and are subject to their terms. Prices are shown in the store in your local currency and may vary by region.
• Refunds for failed generations. If a generation fails on our side, the credits are returned to your balance automatically. Credits spent on generations that succeed are not refundable, even if you would have preferred a different result; redoing a single picture or reading costs less than a whole scene for that reason.
• Refunds of money for purchases are handled by Apple or Google under their refund policies, since they process the payment. We cannot issue store refunds ourselves.
• Credits have no cash value, cannot be transferred between accounts and are forfeited when an account is deleted.

3. Subscriptions

• Monthly plans ("Plus" and "Family") grant a set number of credits at the start of each billing period. Plan credits are added to your balance when the store confirms each renewal.
• Plans renew automatically each month until cancelled. Payment is charged to your App Store or Google Play account at confirmation of purchase and at each renewal, at the price shown in the store.
• You can cancel at any time in your App Store or Google Play subscription settings. Cancelling stops future renewals; you keep access, and any credits already granted, until the end of the current paid period. Partial periods are not refunded.
• If we change a plan's price, the store will notify you and ask for your agreement before the new price applies.
• Where an introductory offer or free trial is available, its terms are shown in the store before you subscribe.

4. Your content

• You keep ownership of the ideas, text, character descriptions and photos you provide ("Your Content").
• You give us permission to store, process and send Your Content to our service providers solely to provide the Service to you, as described in the Privacy Policy.
• You are responsible for Your Content. Only upload photos you have the right to use. If a photo shows a child, you must be the child's parent or legal guardian, or have the guardian's permission.

5. Generated content

• The stories, illustrations and narration the Service creates for you ("Generated Content") are yours to keep, read, share with family and friends, print and otherwise use for personal, non-commercial purposes. To the extent we hold any rights in Generated Content, we assign them to you.
• Generated Content is produced by AI models. It may sometimes be inaccurate, odd or not what you intended, and similar prompts from different users may produce similar results. Please read and listen to a story before sharing it with a child.
• You may not present Generated Content as being endorsed by Twingdle, or use it in a way that breaks the acceptable use rules.
• We may remove Generated Content that violates these terms or the law.

6. Acceptable use

Twingdle is for making kind, age-appropriate stories. You agree not to use the Service to:

• request or create content that is sexual, violent, hateful, frightening or otherwise unsuitable for children, or that harasses, threatens or demeans any person;
• upload photos of people without the right to do so, or create characters that impersonate real people in a misleading or harmful way;
• infringe anyone's copyright, trademark or other rights;
• attempt to bypass our content screening, credit system or purchase verification, or to access other users' data;
• reverse-engineer, scrape or overload the Service, or resell access to it.

Ideas are screened before generation. We may refuse a request, remove content, or suspend or close an account that breaks these rules, and in serious cases we may do so without warning. Credits are not refunded for accounts closed for abuse.

7. The Service

• We work hard to keep the Service available, but it is provided "as is" and we cannot promise it will be uninterrupted or error-free. Generation times vary with demand.
• We may add, change or remove features, art styles, narrators or pricing. Where a change materially affects credits you have already bought, we will give reasonable notice.
• We may discontinue the Service. If we do, we will give at least 30 days' notice and, where the law requires, refund unused purchased credits.

8. Our intellectual property

The Twingdle name, logo, app, website and everything in them other than Your Content and your Generated Content belong to Twingdle or our licensors. These terms do not give you any right to use our branding.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law: the Service and Generated Content are provided without warranties of any kind, express or implied; we are not liable for any indirect, incidental, special or consequential loss, or for loss of data or profits; and our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory consumer rights.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or close your account if you break these terms, if required by law, or if we discontinue the Service. Sections 4 to 12 survive termination.

11. Governing law

These terms are governed by the laws of [[JURISDICTION]], and any dispute will be heard by the courts of [[JURISDICTION]], without prejudice to any mandatory consumer-protection rights you have where you live.

12. Changes to these terms

We may update these terms from time to time. We will post the new version here with a new effective date and, for significant changes, tell you in the app at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated terms.
